6.4 Recipe Sharing Guidelines

If you want to share our recipes on your website or blog:

You MAY: ✅ Write a brief description in your own words (2-3 sentences)
✅ Share 1-2 ingredients as a teaser
✅ Use ONE of your own photos (not ours)
✅ Link directly to our full recipe
✅ Provide clear attribution to The Fryerist

You may NOT: ❌ Copy the full recipe text
❌ Copy the full ingredient list
❌ Copy our step-by-step instructions
❌ Use our photographs
❌ Present the recipe as your own

Example of proper sharing:

"I recently tried The Fryerist's Crispy Air Fryer Chicken Wings, 
and they were amazing! The recipe uses a simple seasoning blend 
and cooks in just 25 minutes. Get the full recipe at The Fryerist:

6.5 Requesting Permission

For uses not covered above, contact us for permission:

7.3 Content Moderation

We reserve the right to:

  • Review User Content before or after publication
  • Edit, remove, or refuse to publish User Content
  • Delete User Content that violates these Terms
  • Ban users who repeatedly violate these Terms
  • Cooperate with law enforcement regarding illegal content

We are not obligated to:

  • Monitor all User Content
  • Review User Content before publication
  • Remove content simply because someone requests it
  • Intervene in disputes between users

Content moderation is at our sole discretion.

  • Take responsibility for User Content

12.1 Maximum Liability

IF WE ARE FOUND LIABLE DESPITE THE ABOVE LIMITATIONS, OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:

  • The amount you paid us in the 12 months preceding the claim (if any)

12.2 Jurisdictions That Don’t Allow Limitations

Some jurisdictions don’t allow limitations on implied warranties or liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless The Fryerist and its owners, authors, contributors, partners, and service providers from any claims, damages, losses, liabilities, and expenses (including attorney’s fees) arising from:

  • Your violation of any rights of another person or entity
  • Your User Content
  • Your negligence or willful misconduct
  • Your violation of any applicable laws

We reserve the right to:

  • Assume exclusive defense and control of any matter subject to indemnification

14. Dispute Resolution

14.1 Informal Resolution

Before filing any formal claim, you agree to:

  3. Allow 30 days for us to attempt to resolve the dispute informally

We’ll work in good faith to resolve disputes amicably.

14.2 Binding Arbitration

IF INFORMAL RESOLUTION FAILS, YOU AGREE THAT ANY DISPUTE ARISING FROM THESE TERMS OR YOUR USE OF THE SITE WILL BE RESOLVED THROUGH BINDING ARBITRATION, NOT IN COURT.

Arbitration terms:

  • Conducted by The Arbitration Foundation of Southern Africa (AFSA) under its Commercial Arbitration Rules
  • Single arbitrator selected per AAA rules
  • Location: Strictly South Africa
  • Governing law: See Section 16 below
  • Each party bears own attorney’s fees unless arbitrator decides otherwise
  • Arbitrator’s decision is final and binding

Exceptions to arbitration:

  • Small claims court cases (if they qualify)
  • Intellectual property disputes
  • Requests for injunctive relief

14.3 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES ONLY ON AN INDIVIDUAL BASIS.

You waive the right to:

  • Participate in class actions
  • Serve as a class representative
  • Join consolidated proceedings
  • Participate in representative actions
  • Join private attorney general actions

Each party may only bring claims against the other on an individual basis.

14.4 Jury Trial Waiver

TO THE EXTENT ARBITRATION DOESN’T APPLY, YOU WAIVE YOUR RIGHT TO A JURY TRIAL.

Any disputes resolved in court will be decided by a judge, not a jury.

15. Governing Law and Jurisdiction

15.1 Governing Law

These Terms and your use of the Site are governed by the laws of South Africa, without regard to its conflict of law provisions.

15.2 Venue

For disputes not subject to arbitration:

  • Exclusive jurisdiction and venue shall be in South Africa
  • You consent to personal jurisdiction in these courts
  • You waive any objection to venue or inconvenient forum

16. International Users

16.1 Global Access

The Site is controlled and operated from South Africa. We make no representation that the Site is appropriate or available for use in all locations.

If you access the Site from outside South Africa:

  • You do so at your own initiative

  3. Statement under penalty of perjury that removal was a mistake or misidentification
  4. Your name, address, and phone number
  5. Statement that you consent to jurisdiction in your district federal court
